Please note the information below provides only a summary of the most recent changes we've made to your Agreement. It is your responsibility to read the full Agreement, including the revised Terms and Conditions, to understand your and our rights and obligations.
Changes to your Agreement: (Any words that are capitalized here are defined in Section 23 of the Terms and Conditions).

New Terminology |
We have updated some of our defined terms (see Section 23), including to provide some changes from Amex on the threshold for becoming a High CV (Charge Volume) Merchant, and we have introduced some new terms. Our defined terms are capitalized when they are used throughout your Agreement. |
Prohibited Businesses, Goods or Services |
We have updated Section 6.4.7 to reflect the current categories of prohibited businesses, goods or services for which you are not permitted to accept cards, as determined by TD and the payment card networks. |
Submitting Transactions |
We have clarified (in Section 6.5) the timing for the submission of transactions in order to meet payment card network timelines and to avoid incurring additional fees. |
Google Pay |
If you elect to accept payments using the Google Pay service, then you must agree to the Google Pay Terms of Service and Acceptable Use Policy. This is now set out in Section 6.7. |
Chargebacks |
We have clarified (in Sections 12.1 and 16.10) TD’s role in relation to chargebacks, which is to process chargebacks in accordance with the payment card network rules (this is not within the discretion of TD). While TD may assist you in disputing a chargeback, TD does not have control over chargebacks and cannot reverse chargebacks. |
Notice Requirements |
We have clarified (in Sections 15.1 and 18.7.2) that certain notices must be provided in accordance with the notice periods set out in the Code of Conduct for the Credit and Debit Card Industry (the “Code”). The current notice period under the Code that applies to these Sections is 90 days, but if Code requirements change, the notice period required under your Agreement will always be the period that is required under the Code. |
Webstore Provisions |
We have added Section 17 and Schedule G, which sets out the terms and conditions of our Ecommerce Webstore and our related Bundled Webstore Services. These capitalized terms are now defined in Section 23. TD has collaborated with BigCommerce to provide you with a convenient way to access and use an Ecommerce Webstore that is integrated with TD's merchant services. Please visit td.com/td-ecommerce-solutions for more details. |
Our Responsibility |
We have clarified (in Section 20.1.2) that we are not responsible for claims resulting from the application of a special interchange program or your use of the Ecommerce Webstore. |
