This offer is being fulfilled on our behalf by UGO Mobile Solutions, a division of The Toronto-Dominion Bank.
PART A Definitions:
"Eligible Borrower" means an individual who (as the original borrower) has an existing vehicle loan with TD Auto Finance at the time of their receipt of the Offer;
“Eligible Loan" means a new loan with TD Auto Finance (Canada) Inc. ("TD Auto Finance") for an Eligible Vehicle to an Eligible Borrower entered and funded through a Participating Dealer on or before January 2, 2025;
"Eligible Vehicle" means select a new Chevrolet, GMC or Buick vehicle, where the total amount financed, including warranties and other financed items is equal to or exceeds $7,500 Can. Recreational vehicles (RV), marine, powersports, and recreational products are excluded. Certain manufacturer programs are excluded from this Offer. Please see your Participating Dealer for full details;
"Offer" means the offer described in Part B, Section 1;
"Participating Dealer" means a TD Auto Finance dealer approved to participate in fulfillment of the Offer;
“Promotional Period” means the period starting on May 29, 2024 and ending on January 2, 2025 inclusive;
“Qualifying Criteria” means the conditions set out in Part B, Section 2 below.
“Terms” mean these terms and conditions that govern this Offer;
“you” and “your” mean any Eligible Borrower;
“we”, “us”, “our” and “TD Auto Finance" mean TD Auto Finance (Canada) Inc., The Toronto-Dominion Bank and any of its worldwide subsidiaries and affiliates:
PART B:
1. The Offer:
Provided you fulfill the Qualifying Criteria in Section 2 and the conditions set out in Section 3 below, you may elect to receive the following (see additional terms and conditions below):
A $200 Esso™ and Mobil™ e-Gift Card
Esso™ and Mobil™ e-Gift Cards are perfect for people on the go. Use them for fuel, car washes, snacks and most other purchases at approximately 2,000 Esso™ and Mobil™ branded service stations.
(each such e-Gift Card is individually referred to as the “Gift Card”)
2. How to qualify for the Offer:
To qualify for this Offer you must:
a. Be an Eligible Borrower;
b. In receipt of a valid communication from TD Auto Finance advising you that you may qualify for the Offer;
c. Take out an Eligible Loan within the Promotional Period and have the related vehicle delivered and the loan funded no later than January 2, 2025;
3. The following conditions also apply to this Offer:
a. The Offer is available to an Eligible Borrower only. Co-buyers on an existing TD Auto Finance loan, loan guarantors, loan assignees and TD employees and their family members, are not eligible to participate in the Offer;
b. Only one Gift Card per Eligible Borrower, no matter how many Eligible Loans may be taken out during the Promotional Period;
c. Only one Gift Card per Eligible Loan, even if the Eligible Loan is taken out with a co-buyer and the Qualifying Criteria are fulfilled by one or more of the co-buyers. In this case, only the buyer designated on the Eligible Loan will qualify for the Offer;
d. Your Eligible Loan must remain open and in good standing until the end of the Promotional Period;
e. In order to select and receive the Gift Card, you must have a valid deliverable email address associated to your client profile with us. It is your responsibility to keep your email address with us up to date;
f. We will advise you by email when you have fulfilled the Qualifying Criteria and qualified for the Offer. The email message will contain a secure link that will permit you to securely obtain your Gift Card. Please allow up to 60 calendar days from the date of delivery of your Eligible Vehicle to receive this email;
g. If you believe you have qualified for the Offer but have not received the email described above informing you of your qualification, you have until February 28, 2025 to inform us of this fact. Any notice received after this date, will not be accepted and you will be deemed not to have qualified for this Offer;
h. You have until March 31, 2025 to use the secure link provided in the email informing you of your qualification for the Offer and how to obtain your Gift Card;
i. Your rights, benefits and responsibilities with respect to the use and operation of Gift Card are governed by the terms of the Gift Card itself. You may find such terms at: giftcards.esso.ca/terms. We are not responsible for any failure, malfunction or defect in the Gift Card, nor for any services related to it. Any complaint, enquiry, or communication related to any failure, malfunction or defect in the Gift Card as well as any services related to it, should be addressed directly to the Gift Card's issuer;
j. Additional Conditions that apply to the Offer:
(i) The Offer is not transferable and cannot be combined with any other of our offers or promotions, except as we may permit;
(ii) We reserve the right to change the Offer and these terms at any time, with or without notice to you;
(iii) We reserve the right to cancel the Offer at any time for any reason at our complete discretion without notice;
(iv) In the event of a conflict between these Terms and the content of any document, brochure or promotional material advertising the Offer, these Terms shall prevail;
(v) We reserve the right, in our sole discretion, to suspend, disqualify, limit or revoke this Offer to any person we find or believe to be manipulating or otherwise abusing the process, fairness, integrity or operation of the Offer, including any person whose overall client relationship with us is in our opinion not in good standing.
Digital and plastic EssoTM and MobilTM Gift Cards, are redeemable in-store at participating retail stations in Canada, but it may not be redeemed for cash except if permitted by law, applied as payment on an Esso™ or Mobil™ account, or used to buy another gift card. Imperial Oil is not responsible for replacing the value of any of these cards if lost, stolen, destroyed, damaged or used without your consent. Gift Cards are not reloadable at the station.
